Excerpt from A New Abridgment of the Law, Vol. 4<br><br>According to the civil and canon law there are three persons who are called executors, and who have to do with the execution of a person's goods after his decease. The first is the ordinary, or bishop of the diocese, and he is called executor lege a constitutus. The second is executor a testatore constitutus, being appointed by the last testament of the party. The third is executor ab episcopo constitutus, who in the civil law is called executor dativus, and in our law an administrator.<br><br>Godolph. 75; Swinb. 205 b. See for definition of executor, Bouv. L. D. h. t.; aslo, 3 Atk. 304; 2 P. Wms. 548; 1 Will. on Ex. 112.<br><br>As the manner of appointing executors and administrators, and the nature and duty of their offices, have been matters of great debate and controversy in our law, it will be necessary to branch out this head into several divisions; and therefore we shall consider,<br><br>(A) What persons may be Executors: And herein,<br><br>1. Of appointing the King Executor.<br><br>2. Whether Corporations may be Executors.<br><br>3. Who, in respect of their Crimes, are disabled from being Executors.<br><br>4. Who in respect of their Country.<br><br>5. Who in respect of their Want of Understanding.<br><br>6. Who in respect of their Fortune and Circumstances; and therein of obliging an Executor to give Security.<br><br>7. Of making Infants Executors.<br><br>8. Of a Feme Covert Executrix.<br><br>9. Of making Creditors Executors.<br><br>10. Of making Debtors Executors.<br><br>(B) Of the different Kinds of Executors and Administrators: And herein,<br><br>1. Of an Administrator durante minori tate of an Infant Executor or Administrator: And,<br><br>1. Who may be such an Administrator.<br><br>2. What Acts he may do.<br><br>3. When his Authority determines.<br><br>2. Of an Administrator de bonis non, where the first Administrator dies, or the Executor dies intestate, or without Probate of the Will: And,<br><br>1. In what Cases Administration de bonis non shall be granted, and to whom.<br><br>2. What things unadministered such an one is entitled to.<br><br>3. In what Actions commenced before his Time, may an Administrator de bonis non proceed.<br><br>3. Of an Executor de son tort: And,<br><br>1.
